Big Regulatory and Legislative Happenings
are Around the Corner!

For those who did not get a chance to attend 2024's AANC Connect Conference at the end of May, there were some big legislative proposals discussed that have been filed and will be considered in this year's "Short Session" of the NC Legislature. The first of these was the introduction of 2 new Bills that would each propose to tackle the rising problem of "squatters" in residential properties. In fact, AANC member and State Representative John Bradford's bill (HB 984) has already been scheduled for a hearing before the Judiciary 1 Committee on Wed. June 5th. These 2 bills would each create a brand-new remedy, outside of the Summary Ejectment process, that would permit landlords who find their rental property is being occupied by an unauthorized "squatter" to remove them without having to file a lawsuit to do so. These have received favorable receptions thus far, so stay tuned for future updates.
The second was the introduction (again by Rep. Bradford) of HB 1070, dealing with "Property Rights and Protections" for residential properties. This bill proposes to make changes to the existing Landlord-Tenant laws that would modernize some provisions and bring them into conformity with the realities of eFiling and electronic entry of Judgments (in the counties where it is operating currently and those still to come online later in 2024/2025); it would also provide an opportunity for a hearing on issues relating to tenants who appeal their eviction Judgments and claim indigent status; would clarify the timeframe that a Clerk has to disburse to the Landlord tenant's rent bond payments during an appeal to District Court; and prevent the fraudulent leasing or rental, or fraudulent advertisement for sale, of residential property by someone who is not the owner.
And finally, on the Federal side of things, there is the long-awaited (and still-unpublished) Final Rule on "Junk Fees" expected to be issued by the Federal Trade Commission any day now - the big questions are: after all the advocacy of the NAA and its constituent members during the Summer and Fall last year, how wide a net will the FTC cast when trying the reel in activities that are currently commonplace in the rental housing market? How will they define the difference between a prohibited "Junk Fee" and an acceptable/legitimate "business transaction fee"? What type of disclosures will be required to be given to applicants by Landlords, and at what point in the rental application process will they be required? And most importantly - what changes will be required to be made to form Lease contracts to account for these new requirements? Many have received notification last week that NAA and Blue Moon have prepared new language for their Lease and addenda forms, but those remain the subject of speculation for now, as they have not been released just yet, while we all await the publication of the Final Rule itself. Again - stay tuned here as NAA expects the rule to be released literally any day now, so as always: watch this space for all the new developments to come!

The 2024 Lobby Day on April 29 was a significant success for AANC, with members representing the local affiliates from across the state advocating on policies that impact the rental housing industry and its residents. Advocates met with lawmakers on several priorities, including AANC-supported HB 551: Landlord-Tenant and HOA Changes, eCourts challenges and summary ejectment challenges. This year's Lobby Day was marked by a strong turnout, reflecting the industry's pressing concerns and legislative priorities. Thank you to every person who attended this year!
The week before Lobby Day, the North Carolina General Assembly convened for the short session on April 24. The second year of the legislative biennium, lawmakers are working to adjust the two-year state budget passed in 2023 and finish up legislative priorities that were discussed in the 2023 long session or interim months.
In addition to HB 551, AANC is working on several other bills to actively support their passage, such as HB 1070: Property Rights and Protections, which seeks to further streamline the summary ejectment process, and several squatters bills: HB 966/SB 886: Expedited Removal of Unauthorized Persons and HB 984: Removal of Squatters from Private Property.
AANC is also monitoring several bills with impact to the rental housing industry, including: SB 802: C-PACE Program and SB 166: 2024 Bldg. Code Regulatory Reform.
The legislature is expected to adjourn for the year later this summer, ahead of the November election season heating up. At the end of session, AANC will release an overview of what passed into law, what did not, and the industry’s biggest successes from the legislative biennium.

RHALS 2024 The 2024 Rental Housing Advocacy and Legal Summit (RHALS), formerly Government Affairs Roundtable (GART) and Legal Symposium, is NAA's event that connects and educates government affairs professionals and volunteers while discussing pressing rental housing industry issues happening all over the country. Will be held in Irving, Texas July 30 – August 1. Registration is now open.
RHALS offers attorneys an opportunity to earn CLE credits while discussing the trends, threats and challenges facing the rental housing industry. It is a must-attend event for all industry professionals seeking to stay informed and prepared to contend with the ever-evolving world of rental housing law and regulation.

May has been busy in the mountains with AAWNC hosting CPO on May 3, Maintenance Appreciation Bowling on May 8 and Yappy Hour on May 16! Maintenance Appreciation proved to be a fun-filled night at Sky Lanes in Asheville. The night was packed with more than 65 attendees. 39 maintenance team members came out for the fun and to be celebrated!
Greater Fayetteville Apartment Association (GFAA)
On May 16, 2024 GFAA celebrated our leasing team members with Leasing Appreciation Karaoke at Twisted Grape in Cameron, NC. We had a great turnout with some even getting behind the microphone to sing.
In addition, members from the GFAA Membership Outreach Committee delivered flowers and a personal invitation to leasing team members in the Fayetteville market.
Piedmont Triad Apartment Association (PTAA)
In April, the PTAA kicked off our Twentieth Annual Food Drive in partnership with Second Harvest Food Bank of NW NC at their Diamond Awards. For 2024, the PTAA set a goal of raising over 500,000 meals by the end of summer. The PTAA Food Drive is probably best known for our Fill the Stands with Cans events at the Greensboro Grasshoppers and Winston-Salem Dash ballparks. At these games, PTAA members solicit donations from attendees before the first pitch. PTAA members are also participating by hosting food drives in their communities and by having donation boxes in high-foot traffic areas for residents to donate.
Triangle Apartment Association (TAA)
TAA welcomed the second quarter at our annual trade show, with the theme Let the Games Begin, inspired by the 2024 Olympics. Attendees enjoyed engaging exhibitor booths, activities, and networking. During the show, TAA’s Education Committee held its 24th Battle of the Baskets fundraiser, with baskets donated by member companies. The raffle raised over $6,860, with proceeds to benefit the Copper Circle Education Scholarship Fund.
Our Government Affairs department has been actively advocating for the needs of the multifamily housing industry. TAA’s Government Affairs Committee and Housing Affordability Subcommittee regularly hosted government officials and housing director guest speakers at their meetings. Speakers include NC Senator Natalie Murdock, City of Durham Director of Community Development Reginald Johnson, and Raleigh City Councilwoman Jane Harrison.
TAA introduced its Leadership Lyceum program this year, with graduation right around the corner! This 4-month program identifies and develops admirable, highly motivated, and committed multifamily housing individuals for future volunteer leadership roles and opportunities with TAA. It has been a pleasure to watch this group of professionals grow in their skills and confidence, and we are certain they will be great leaders within our industry and at TAA.
As TAA celebrates its 40th anniversary as an association, we reflect on decades of connecting with professionals in the multifamily housing industry. As we seek new and innovative methods to engage with our members, TAA’s XCEL Committee is proud to launch The XCEL Effect, a podcast that delves into various topics related to the multifamily housing industry. We invite you to tune in and listen!
